| Resumo: | No presente trabalho analisa-se o negócio fiduciário – e suas modalidades de alienação fiduciária e de cessão fiduciária – e como tal instituto é visto quando aplicado à recuperação judicial. Os fundamentos do tema proposto são encontrados nas normas que tratam do negócio fiduciário, na legislação falimentar, na doutrina, e na atuação de juízes e tribunais. Para alcançar a finalidade da presente pesquisa, o qual é dividido em quatro capítulos, inicia-se com a análise do sistema financeiro e das garantias por ele utilizadas, nas quais se destaca o negócio fiduciário. No segundo capítulo, há um estudo mais aprofundado sobre o negócio fiduciário e suas modalidades – a alienação fiduciária de bens móveis, a alienação fiduciária de bens imóveis e a cessão fiduciária de títulos e direitos. Na sequência, no terceiro capítulo, vê-se a recuperação judicial e os princípios aos quais tal procedimento deve acatar. Por fim, no quarto e último capítulo, são vistos os créditos sujeitos à recuperação judicial e a justificativa para exclusão dos créditos garantidos pelo negócio fiduciário dos efeitos da recuperação judicia |
| Abstract: | The present article analyzes the fiduciary transaction – and its modalities of fiduciary alienation and fiduciary assignment – and how such institute is seen when applied to judicial reorganization. The fundamentals of the subject are found in the rules dealing with the fiduciary transaction, bankruptcy legislation, doctrine, and the interventions of judges and courts. To achieve the purpose of this research, which is divided into four chapters, begins with the analysis of the financial system and guarantees used by it in which it is highlighted the fiduciary transaction. In the second chapter there is a further study on the fiduciary transaction and its modalities – the alienation of movable property, the alienation of immovable property and the assignment of rights and titles. Further, in the third chapter, it is verified the judicial reorganization and the principles to which this procedure should abide by. Finally, in the fourth and final chapter, are seen the credits subject to judicial reorganization and the justification for the exclusion of those credits guaranteed by fiduciary transaction from the effects of judicial reorganization |
