Whistleblowing: aplicabilidade no combate à corrupção brasileira e a proteção ao denunciante

Abstract

Corruption is one of the main obstacles to institutional and economic development in Brazil, directly affecting the relationship between the public sector and private entities. In this context, whistleblowing – understood as the act of reporting illicit or unethical conduct within organizations – emerges as a relevant tool in combating corruption. This paper analyzes the applicability of whistleblowing in the Brazilian context, emphasizing the urgent need for specific legislation, adequate protection for whistleblowers, and the creation of incentives that foster a culture of integrity. The research explores the role of compliance programs, reporting channels, anonymity guarantees, and anti-retaliation measures. Furthermore, it examines international experiences, with a focus on the U.S. model, and presents practical cases to illustrate both the challenges and advancements in this field. The study concludes that strengthening whistleblowing in Brazil requires a robust legal framework, institutional protection policies, and societal engagement in promoting ethics and transparency
