| Resumo: | A presente pesquisa tem como objetivo analisar o regime jurídico da coisa julgada coletiva à luz do Tema de Repercussão Geral nº 1.075 do Supremo Tribunal Federal (STF), com foco nos limites subjetivos e territoriais da eficácia da sentença. O problema se justifica pela necessidade de garantir a efetividade da jurisdição coletiva e a segurança jurídica, após a tese firmada pela Corte em 2021, que reconheceu a inconstitucionalidade da limitação territorial prevista no artigo 16 da Lei nº 7.347/1985. A hipótese central é que a decisão do STF fortalece a tutela coletiva ao reafirmar que a coisa julgada não se restringe a limites geográficos, mas aos limites objetivos e subjetivos da decisão, conforme o dano. Metodologicamente, adota-se abordagem dogmática, analisando a legislação aplicável (LACP e CDC) e a evolução jurisprudencial. Os resultados obtidos indicam que a coisa julgada coletiva possui eficácia subjetiva expandida (erga omnes ou ultra partes) e que a vedação à restrição territorial é essencial para que a solução molecular dos conflitos alcance todos os titulares, independentemente da circunscrição judicial |
| Abstract: | This research aims to analyze the legal regime of collective res judicata in light of Supreme Federal Court (STF) General Repercussion Topic nº 1.075, focusing on the subjective and territorial limits of the sentence's effectiveness. The problem is justified by the need to guarantee the effectiveness of collective jurisdiction and legal certainty, following the 2021 ruling that recognized the unconstitutionality of the territorial limitation provision in Article 16 of Law nº 7.347/1985. The central hypothesis is that the STF's decision strengthens collective protection by reaffirming that res judicata is not restricted to geographical boundaries, but to the objective and subjective limits of the decision, depending on the scope of the damage. Methodologically, a dogmatic approach is adopted, analyzing applicable legislation (LACP and CDC) and jurisprudential evolution. The results obtained indicate that collective res judicata possesses expanded subjective effectiveness (erga omnes or ultra partes) and that the prohibition of territorial restriction is essential so that the molecular solution of conflicts reaches all rights holders, irrespective of the judicial circumscription |
