| Resumo: | O trabalho, que pretende demonstrar a utilidade do Direito Constitucional Comparado no mundo globalizado, e a necessidade de formulação de uma Teoria Geral da Comparação Constitucional, parte do tratamento de questões como a formação do Estado, a existência ou inexistência da pós modernidade, ou de uma hiper modernidade; e as relações entre o Estado; com sua configuração atual e no porvir imediato; e o momento pós, ou hiper moderno. Concluindo-se que o Estado Constitucional vem transformando-se em Estado Constitucional Cooperativo, apresenta-se uma introdução à comparação, e formulam-se, com base em proferências acerca do novo tipo de Estado, postulados que devem ser necessariamente observados pelo comparatista, seja um jurista ou um intelectual, ou ainda alguém no âmbito executivo, legislativo ou judiciário do Estado, ou ainda no âmbito de Organizações supranacionais |
| Abstract: | The thesis, which intents to show the utility of comparing constitutions, and the necessity to formulate a General Theory for Constitutions Comparison, part of the treatment to questions such as the creation of state, the existence or not existence of post- modernity, or hyper modernity, and the relationships between state; with its current configuration and in the immediate future, as the post modern or hyper-modern moment. One may be able to conclude that the Constitutional state is becoming a Cooperative Constitutional state. The presented here is an introduction to this comparison, and, based in the comprehension of a new type of state, rules are formulated on this new state. Rules these, that must be observed by the one who compares, either if is he a jurist or an intellectual, or even someone in the executive, legislative or judiciary spheres of state, or in the range of ultra-national organizations |
